1. General

These General Terms and Conditions (GTC) regulate the legal relationship between MinaDays GmbH ("Seller") and its customers ("Customer") in connection with orders placed via the online shop and via other ordering channels, if used.

Deviating conditions of the customer are not recognized, unless the seller expressly agrees to their validity.

3. Offer and Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.

By completing the order process and clicking the appropriately marked order button, the customer submits a binding offer to purchase the selected goods.

The contract is concluded as soon as the seller accepts the order by an order confirmation or shipping confirmation via e-mail.

Offers are only valid as long as they are available in the online shop and while stocks last.

Orders and deliveries are made to the delivery countries specified in the online shop.

4. Prices and Payment Terms

The prices stated in the online shop include the respective applicable statutory value-added tax.

Prices are displayed to customers in their respective national currency.

Payment is made via the payment methods offered in the online shop.

For payment service providers such as PayPal, Klarna, Apple Pay, Google Pay, Shop Pay, Twint or credit card providers, their respective contractual and data protection provisions also apply.

The goods remain the property of the seller until full payment has been received.

5. Delivery and Shipping

The available delivery times are indicated in the online shop. Delivery times may be extended in the event of unforeseen events or delays caused by third parties.

For consumers, the risk of accidental loss or accidental damage to the goods passes only upon handover of the goods to the customer or an authorized recipient.

The customer is requested to report obvious transport damage as soon as possible. The customer's legal rights remain unaffected by this.

6. Right of Withdrawal and Return

Consumers have the statutory rights of withdrawal according to the respective applicable legal provisions.

Details on the right of withdrawal, the withdrawal period, the consequences of withdrawal, and the sample withdrawal form are listed in the separate withdrawal policy on the seller's website.

The right of withdrawal does not apply to goods that are not suitable for return for reasons of health protection or hygiene, if their seal has been removed after delivery and the legal requirements for exclusion are met.

7. Warranty

The statutory warranty rights apply.

The customer is requested to report obvious defects or transport damage as soon as possible. The customer's legal rights remain unaffected by this.

No warranty is given for damage caused by improper use, natural wear and tear or improper storage.

8. Liability

The seller is liable without limitation for damages resulting from injury to life, body or health, as well as for damages based on intent or gross negligence.

In the event of slightly negligent breach of essential contractual obligations, the seller is only liable for the foreseeable, typical damage, to the extent legally permissible.

Otherwise, liability is excluded to the extent legally permissible.

Mandatory liability under applicable product liability laws remains unaffected.

9. Product Information

The products must be used in accordance with the respective product information and application instructions.

In case of known allergies or intolerances, the ingredients must be checked before use. In case of health concerns, professional advice should be sought before use.

The product descriptions do not replace individual medical advice.

10. Data Protection

Information on the processing of personal data can be found in the seller's privacy policy.

The processing of personal data is carried out in accordance with the respective applicable data protection regulations, in particular the Swiss Data Protection Act (DSG) and - where applicable - the General Data Protection Regulation (GDPR).

Promotional communication will only take place within the legally permissible framework. Consent to promotional messages can be revoked at any time.

11. Copyrights

All content of the online shop, in particular texts, images, graphics, logos, videos and designs, are protected by copyright.

Any use, reproduction or dissemination without the prior consent of the rights holder is not permitted.

12. Applicable Law and Consumer Rights

Swiss law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).

With regard to consumers ordinarily resident in another state, the mandatory statutory consumer protection provisions of the respective state of residence remain unaffected.

With regard to consumers, the statutory rules on jurisdiction apply.
