1. Scope of Application

These General Terms and Conditions (GTC) apply to all contracts, deliveries, and other services between Minadays (hereinafter "Provider") and the customer (hereinafter "Customer") that are concluded via the website, by e-mail, by telephone, or by any other means.

3. Conclusion of Contract

The presentation of products or services on the website does not constitute a legally binding offer, but rather a non-binding invitation to order. By submitting an order, the customer makes a binding offer to conclude a contract. The provider may accept this offer within 5 working days by way of an express declaration of acceptance or by executing the order.

4. Prices and Payment Terms

All stated prices are in Euros and, unless otherwise specified, include statutory value-added tax. The prices applicable at the time of the order shall apply.
Payment can be made via prepayment, PayPal, credit card, or another agreed payment method.

5. Delivery and Performance Time

Deliveries are made subject to availability. Delivery dates are non-binding unless a binding delivery date has been expressly agreed upon.
The risk of accidental loss and accidental deterioration passes to the customer upon handover to the shipping company.

6. Right of Withdrawal

Consumers have a statutory right of withdrawal. Information regarding the right of withdrawal as well as a model withdrawal form are provided separately or are available on the website.

7. Warranty and Liability

Statutory warranty rights apply.
The provider is only liable for damages based on intentional or grossly negligent conduct. In cases of slight negligence, the provider is only liable for the breach of essential contractual obligations.

The protection of your personal data is important to us. Information about the nature, scope, and purpose of the collection and use of personal data can be found in our privacy policy.

9. Final Provisions

Should individual provisions of these GTC be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.
The place of jurisdiction is – to the extent permitted by law – the registered office of Minadays.

§ X Guarantee
In addition to statutory rights regarding defects, a voluntary manufacturer's guarantee may exist for certain products. The consumer's statutory rights regarding defects against the seller remain unaffected and are not limited by the guarantee.

Insofar as a manufacturer's guarantee exists for a product, the guarantor, the scope of the guarantee, the duration of the guarantee, the geographical area of application, and the requirements and procedure for asserting the guarantee are set out in the respective guarantee declaration.

The guarantee may, in particular, be conditional upon the product having been used as intended. Details regarding any exclusions and requirements can be found in the respective guarantee declaration.
